Section 39 — Bar of jurisdiction

What this section requires

No civil court has jurisdiction over any matter the Board is empowered to handle under the Act, and no court or authority can grant an injunction against action taken or intended under the Act.

Anyone seeking to litigate a matter the Board is empowered to handle — this section forecloses that route, directing such disputes to the Board and, on appeal, the Appellate Tribunal instead.

Checklist

• Don't plan around a civil-court injunction as a way to pause Board action — Section 39 forecloses it. The Appellate Tribunal appeal under Section 29 is the available route instead.

Penalty exposure

Not applicable — a bar-of-jurisdiction clause creates no obligation for the Schedule to penalise.
